Please read them carefully before purchasing or using our services. If you disagree with any part of these terms, please refrain from using our website.

1. General Terms

These Terms and Conditions govern your use of our website, including all related services, products, and content provided by WAW Diamonds. By using our website, you accept and agree to comply with these terms and any applicable laws, including the consumer protection laws of Belgium.

2. Eligibility

To purchase items from WAW Diamonds, you must be at least 18 years old or have the legal capacity to enter into binding agreements. By placing an order, you confirm that you meet this requirement.

3. Product Information, Pricing, and Certification

• Product Descriptions: We strive to ensure all product descriptions, images, and prices are accurate. However, we do not warrant that the product descriptions or other content on our website are error-free, complete, or current. In case of inaccuracies, we reserve the right to correct them without prior notice.
• Pricing: Prices on our website are displayed in USD and GBP for your convenience; however, in Belgium, we operate in EUR (Euros). All transactions will ultimately be processed in EUR, and prices include applicable VAT (Value Added Tax) and import duties where noted. Shipping charges, if applicable, are calculated and displayed at checkout.
• Certification:
  • All lab-grown diamond jewelry products purchased on our website come with a third-party diamond grading or jewelry certificate to ensure quality and authenticity.
  • For products with a 1.00 carat or larger lab-grown diamond solitaire, each individual diamond of this size is certified, and you will receive a certificate for every such diamond in the piece. However, a complete jewelry certificate is not provided.
  • For products containing lab-grown diamonds smaller than 1.00 carat, the entire piece of jewelry is certified as a whole, and individual diamond certificates are not provided.
  • Return Policy for Certificates: Customers returning diamond products must include the original third-party certificate with the return. This policy ensures that the returned product matches the original certificate, maintaining transparency and protecting our customers’ interests. If a diamond product is returned without the accompanying certificate, a charge of USD $100 will be applied to the customer.

4. Availability and Customization

WAW Diamonds is dedicated to offering high-quality, unique products to our customers. Please note that seeing an item on wawdiamonds.com does not guarantee that it is in ready stock or will be available when you return to the site.

• Customization Options: Some products may be customized by stone size, grade, metal, and other specifications. Each personalized jewelry piece is handmade to order.

• Resale Restriction: Merchandise available on our website is intended for personal use only and is not for resale.

5. SuperBuy Products and Policies

• Promotion Exclusions: All SuperBuy products cannot be combined with any other promotions.
• Return and Cancelation Fees:
  • Returns after shipping will incur a 12% order processing fee. Cancelations before shipping are free.
  • Orders placed via Klarna will attract a 12% fee for both returns and cancelations, regardless of shipping status.
• Price Match Guarantee: If a customer finds a lower price for the same product within 30 days of purchase, SuperBuy will rebate or return the difference in accordance with our return policy.
• Designer Brand Exclusion: Designer brands are excluded from SuperBuy and are not eligible for promotions or price matching.

6. Warranty and Legal Compliance

In compliance with Belgian law, WAW Diamonds provides a minimum two-year statutory warranty on all products, effective from the date of delivery. This warranty covers manufacturing defects only and does not apply to damage caused by improper use, general wear and tear, or repairs conducted by third parties.

Additionally, WAW Diamonds offers a free lifetime manufacturing warranty on all products purchased on wawdiamonds.com. This non-transferable warranty is valid from the date of purchase for the original buyer only.

• Coverage:
  • High-quality standards and defect-free products are guaranteed through stringent quality assurance processes.
  • The brilliance of our lab-grown diamonds will not fade over time with regular use.
• Exclusions: This warranty does not cover issues arising from:
  • General wear and tear.
  • Loss of center stones, product loss, or theft.
  • Improper cleaning, storage, or trauma, including scratching, metal fading, or discoloration due to inadequate care (caused by chemicals, make-up, pools, hot tubs, bathing, etc.).
  • Prongs or settings that wear down, bend, or loosen over time, allowing stones to fall out.
  • Any repair or service performed by a third-party vendor (including ring sizing).

We will inspect the product upon receipt to determine if it is covered by the warranty. If covered, we will repair or replace the item and ship it back to you free of charge. If not covered, we will provide a quote for repair and shipping costs. Payment will be collected before the item is shipped back to you.

7. Orders and Payment

• Order Confirmation: After placing an order, you will receive an email confirmation. This does not indicate acceptance of your order; we reserve the right to refuse any order for any reason.
• Payment: Payment must be completed at the time of order placement. We accept major credit cards, Klarna, and other payment methods as listed on our website. All payments are processed securely.
• Order Fulfillment: All items are made to order and will be delivered within 14 business days after order confirmation.

8. Shipping and Delivery

• Shipping Methods: We ship securely worldwide using DHL and other specialized carriers for jewelry and valuable cargo to ensure your order arrives safely. Delivery times vary based on your location, and estimated delivery times are provided at checkout.
• Import Duties and Taxes: Import duties and taxes are included in the price where applicable. Customers are responsible for any additional customs fees not covered by us.
• Lost or Delayed Packages: While we take every precaution to ensure safe and timely delivery, we are not responsible for delays or loss caused by shipping carriers. We will assist you in resolving any shipping-related issues.

9. Right of Withdrawal

In compliance with Belgian law, customers have the right to withdraw from the purchase agreement within 14 days of receiving their order without providing any reason. To exercise this right, please contact us at hello@wawdiamonds.com within the 14-day period. Please note that custom-made or personalized items are exempt from this right of withdrawal. If a return is accepted, customers will receive a refund within 14 days after we receive the returned items in their original condition.

10. Returns and Refunds

• Return Policy: We accept returns for items that do not meet your expectations. If you wish to return your item, please contact us within 7 days of receiving your order to initiate the process. Returned items must be in their original condition and packaging.
• Compensation: If you choose to return your order, we will provide compensation in the form of a refund or exchange, based on your preference.
• Refunds: Refunds are processed within 14 days after receiving and inspecting the returned item. Shipping costs are non-refundable.

All content on the WAW Diamonds website, including but not limited to text, images, designs, logos, and trademarks, is the property of Nova Jewelry BV or its content suppliers and protected by copyright, trademark, and other intellectual property laws. You are granted a limited license to use the website solely for personal, non-commercial purposes.

12. Limitation of Liability

To the fullest extent permitted by Belgian law, Nova Jewelry BV (WAW Diamonds) disclaims all warranties, express or implied, relating to the website and products, including implied warranties of merchantability and fitness for a particular purpose. We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use our website or products.
